A severance agreement is a deal between you and your former employer.  In exchange for some severance (usually money), you give up your right to sue the company and promise to go away and be quiet. You may also be making other promises, like not to compete, or to cooperate with the company if ever it needs.

What is included in a flat-fee severance agreement review?

We review your severance agreement carefully and explain what it means in plain English. That includes the amount of severance being offered, the release of claims, confidentiality and non-disparagement obligations, cooperation provisions, references, restrictive covenants, and any other terms that could affect you after your employment ends. Our goal is to make sure you understand exactly what you are being asked to sign before you make a decision. After the review, you get three (3) hours of one-on-one attorney time for follow-up assistance as needed.

Why should I have a lawyer review my severance agreement before I sign it?

A severance agreement is not simply a payment document. In exchange for severance, you are typically giving up valuable legal rights and agreeing to ongoing obligations to your former employer. Because the agreement was drafted by the company, it is important to have an experienced employment lawyer review it from your perspective before you sign.

Can you tell me whether the severance offer is fair?

Yes. We can help you assess whether the offer appears reasonable under the circumstances and whether there may be grounds to seek improved terms. That analysis may include your position, tenure, compensation, the circumstances of your termination, possible legal claims, and the provisions the employer is asking you to accept in return.

Do you also negotiate severance agreements?

Sometimes. Our flat fee service includes assistance with negotiation, but not direct contact with your former employer (i.e. we act as shadow-counsel). In rare cases, we may be able to directly negotiate with your former employer for additional compensation or improved terms, such as better reference language, changes to non-disparagement provisions, clarification of bonus or commission payments, or narrower restrictive covenants.

How is the flat-fee severance review different from severance negotiation?

The flat-fee review does not include direct contract with your former employer. Also, our flat-fee service does not include a contingency portion (i.e. we do not partake in any additional severance you obtain – you keep it all).

Can you review my severance agreement quickly if I have a deadline?

Yes. Severance agreements often come with short response deadlines, and we understand that time matters. We regularly work with employees who need prompt guidance before deciding whether to sign, ask for more time, or begin negotiations. Your agreement should not be signed simply because the employer has created a sense of urgency.

Will you tell me whether I may have legal claims against my employer?

Yes. As part of the review, we can discuss whether the circumstances surrounding your employment or termination raise potential employment-law issues that may affect your severance strategy. That may include discrimination, retaliation, wage and hour issues, breach of contract, bonus or commission disputes, or other claims depending on the facts.

Is the flat-fee severance review worth it if I think I will probably sign anyway?

Often, yes. Even if you ultimately decide to sign, you should know what rights you are waiving and what obligations you are accepting. A severance agreement can affect your legal rights, your future employment, your ability to speak about your experience, and sometimes your post-employment business opportunities. Understanding those terms before signing is valuable in its own right.
